This Privacy Policy describes how MV Motion Advisory LLC (“MV Motion,” “We,” “Our”) collects and processes your personal information (“Personal Information”) when you use our websites, products, and services (our “Platform”) and when you communicate with us. This Privacy Policy applies to all Subscribers to MV Motion Services. Defined terms have the meaning given to them in MV Motion’s Terms of Service if they are not defined below.

MV Motion collects Personal Information that is necessary or appropriate for our business, to improve the usability of our Platform, and to help us tailor content for you. When you register with MV Motion, we will collect your name, employer, email address, location, subscription preferences, preferred method of contact, and any other information you provide to us. We may collect additional information automatically, including analytical information, details about your interaction with our Platform and email distribution list, device information, and what content you have accessed from our website and our email distribution list.
  2. Our Platform uses several ‘plug ins,’ ‘cookies,’ and other trackers, which are described in more detail below, including Google Analytics. These trackers may share your Personal Information with third parties.

If you interact with social media objects (for example, by clicking on a Facebook “like” button), both the platform and your connections on the platform may be able to view that activity.     • Government entities/Law enforcement. We may share information when we believe in good faith that we are lawfully authorized or required to do so to respond to lawful subpoenas, warrants, court orders, legal process, or other regulatory or law enforcement requests, or where necessary to protect our property or rights or the health and safety of our employees, contractors, customers, or other individuals.
    • Other businesses in the context of a commercial transaction. We may change our ownership or corporate organization while providing the Platform. We may transfer to another entity or its affiliates or service providers some or all Personal Information about you in connection with, or during negotiations of, any merger, acquisition, sale of assets or any line of business, change in ownership control, or financing transaction. We cannot promise that an acquiring party or the merged entity will have the same privacy practices or treat your Personal Information as described in this policy.
    • Other entities. There could be instances when we disclose your Personal Information without providing you with a choice to protect the interests, rights or safety of MV Motion or others. Should MV Motion establish future subsidiaries or affiliate companies in the future, then we may disclose Personal Information to these subsidiaries or affiliate companies.
  5. Security of Personal Information. We take reasonable and appropriate steps to maintain the security of your Personal Information, although we cannot guarantee security. Physical, administrative, and technical safeguards are in place to help protect Personal Information.

  6. Retention of Personal Information. Typically, we will retain your name and contact details at a minimum for the duration of our relationship with you, as a client or prospective client of MV Motion. Any data collected for analytics purposes is generally retained for a shorter time, while we are carrying out the relevant analytics. We will retain your Personal Information as needed to fulfill the purposes for which it was collected, and to comply with our business requirements and needs.

  7. Cookies. A cookie is a text file, created when your browser visits a particular website. Every time you visit our website, your browser queries for and retrieves any cookies that have previously been set.

    Cookies enhance the user’s website experience, including authentication, storing preferences, and personalizing the website’s appearance. The cookies MV Motion collects may include the following: a unique identifier, user preferences, and profile information used to personalize the content shown. For example, if you are a Subscriber to MV Motion’s research, then your browser may store a cookie so that you can download our research reports and/or data-files with “one click”. We may collect the physical location of your device using trackers for purposes consistent with this Privacy Policy.

    MV Motion may share your Personal Information and other tracking data with third parties for purposes described in this Privacy Policy as well as those third parties’ own purposes, which may occur when MV Motion uses Google Analytics for example.

    Some web browsers permit you to broadcast a preference that you not be “tracked” online. Our Platform does not recognize these signals at this time.

  8. Cross Border Transfer of Personal Information. We may collect, process, and store your Personal Information in the United States and other countries. The laws in the United States regarding Personal Information may be different from the laws of your country. Any such transfers will comply with safeguards as required by relevant law.

  9. Privacy Disclosures for Specific Jurisdictions - European Economic Area, United Kingdom, and Switzerland. MV Motion processes “personal data,” as that term is defined in the European Union’s General Data Protection Regulation (“GDPR”). MV Motion is the data controller for personal data we collect through our Platform. If you are located in the EEA, U.K., or Switzerland, you have the following rights, subject to some exceptions:

    • Access and Portability: Request access to personal data we hold about you or request transmission of your data to a third party.
    • Correction: Request that we rectify inaccurate or incomplete personal data we store about you.
    • Erasure: Request that we erase personal data when such data is no longer necessary for the purpose for which it was collected, when you withdraw consent and no other legal basis for processing exists, or when you believe that your fundamental rights to data privacy and protection outweigh our legitimate interest in continuing the processing.
    • Restriction of processing: Request that we restrict our processing of personal data if there is a dispute about the accuracy of the personal data; if the processing is unlawful; or if the processing is no longer necessary for the purposes for which it was collected.

  10. Other Contractual Relationships. If you enter into a separate contractual relationship us, which

  11. Other Websites. This Privacy Policy does not apply to sites or services offered by other companies or third parties, which may be displayed as content or linked on our website.

  12. Children’s Data. This Platform is intended for users who are thirteen years old and older. We do not knowingly collect information from children below that age. If we discover that we have inadvertently collected information from anyone younger than the age of 13, we will delete that information. Please contact us with any concerns.
